Dugan and Bolin Successful in Obtaining Summary Judgment

The Circuit Court of Wilcox County granted summary judgment in favor of the firm's client, an insurance company, in a declaratory judgment matter. In an underlying action, Defendant's former employee sued the Defendant/Company for workers' compensation benefits and wrongful termination. Plaintiff alleged in its declaratory judgment action that the policy it issued to the Defendant/Company specifically excluded claims for workers' compensation and wrongful termination and therefore, owed no duty to indemnify the Defendant/Company for the claims made by its former employee. The Court found in favor of the Plaintiff and declared that no duty to

indemnify is owed by the Plaintiff to the Defendant the underlying action.
